Terms of Service

Last updated August 17, 2026

These terms govern use of Midway Metric — the marketing site, operator software, and public event portals. By creating an account, signing in, or using the service, you agree to these terms and our Privacy Policy.

The service

Midway Metric is operations software for fairs and public events (maps, schedules, vendors, staff, ticketing, and related tools). We may change features as we improve the product. Web access is available now; mobile apps may launch later.

A client is the fair or event operator who subscribes. The public are that client’s visitors and ticket buyers. Public event pages are meant to open the event site, not a login wall. Login is optional for guests.

Accounts

You must provide accurate information and keep your password confidential. Client and vendor accounts may be provisioned by invite. You are responsible for activity under your account. We may suspend accounts that abuse the service or these terms.

Client responsibilities

Clients are responsible for the accuracy of maps, schedules, vendor listings, ticket offerings, and public copy they publish; for their own staff and vendors; and for complying with laws that apply to their event (including refunds, accessibility, and tax). Tickets sold through the platform are the client’s tickets. Midway Metric provides software, not the event itself.

Acceptable use

Do not probe or disrupt the service, scrape other people’s data, post unlawful content, or use the product to mislead the public about an event you do not operate. Do not attempt to access another client’s account or data.

Fees

Paid plans and add-on modules are billed as described at checkout or on the pricing page. Ticket processing may include platform and payment-processor fees. Taxes may apply. Subscription changes and cancellations follow the billing screens in the product.

Intellectual property

Midway Metric and its software remain our property. Clients keep rights to their event content. You grant us a limited license to host and display that content in order to run the service.

Disclaimer and liability

The service is provided “as is.” We do not warrant uninterrupted operation during fair week, though we work to keep it available. To the fullest extent allowed by law, Midway Metric is not liable for lost profits, lost data, or indirect damages, or for on-the-ground incidents at an event. Our total liability for a claim is limited to the fees you paid us in the twelve months before the claim.

Termination

You may stop using the service at any time. We may terminate access for breach of these terms. Some sections (including liability limits and intellectual property) survive termination.

Changes and contact

We may update these terms by posting a new version on this page. Continued use after an update means you accept the new terms. Questions: james@midwaymetric.com.
